What Fast & Furious Gets Wrong About a Florida Car Accident Claim

The Fast & Furious movies have taught us many things: a Pontiac Fiero can apparently survive reentry, a runway can be roughly the length of I-75, and every problem, including international espionage, is improved by driving directly through it. What they have not taught us is what to do after a Florida car accident, largely because “Dom Toretto collects the other driver’s insurance information and sees a doctor within fourteen days” does not sell popcorn.

Still, if you have been hit in Spring Hill, Brooksville, or anywhere else in Florida, the gap between a movie crash and a real one is important. In the movies, the cars explode and everybody walks away in a clean T-shirt. In real life, the bumper is bent, your neck hurts tomorrow, and an insurance adjuster calls while you are trying to find the tow yard.

Rule One: You Cannot Draft Behind the Insurance Company

A good movie team has a hacker, a mechanic, an implausibly talented driver, and someone whose only job is to look concerned at a barbecue. The other driver’s insurance company has its own team too. It has adjusters, lawyers, software, and a process built to value the claim before your injuries have fully declared themselves.

That does not make every adjuster a villain in a black leather jacket. It does mean the opening question, “How are you feeling today?” is not casual conversation. If you say “fine” because you are trying to be polite, that answer can become Exhibit A when you learn three days later that you cannot turn your head without making a sound normally reserved for a haunted attic.

Rule Two: The Fourteen-Day Clock Is Not a Plot Device

Florida Personal Injury Protection benefits are governed by section 627.736. In practical English, you generally need initial services and care within fourteen days after the crash for PIP benefits to be payable. That is not a deadline invented by an aggressive chiropractor. It is the law, and it is why “I thought I would sleep on it for two weeks” can become an expensive decision.

Get checked out. Follow the medical advice you are given. Keep the paperwork. No one receives an Oscar for bravely ignoring pain in the parking lot of a Publix.

Rule Three: Speed Does Not Eliminate Physics, or Fault

The Fast & Furious solution to an obstacle is usually more speed. Florida negligence law takes a less cinematic view. Florida uses modified comparative negligence in most negligence cases. If you are partly at fault, that can reduce your recovery. If you are found more than fifty percent at fault, you generally recover nothing. See section 768.81.

So do not assume the crash report has written the final ending, and do not assume it tells the whole story. Take photographs of the vehicles, the road, debris, traffic controls, and the scene before it disappears. Get witness names. Preserve the story while it is still a story and not an adjuster’s summary of a story.

Rule Four: “Family” Is Not an Insurance Policy

This is the least fun part, so naturally it is the most useful. Florida does not require ordinary drivers to carry bodily injury liability coverage. The driver who rear-ended you may have caused a very real problem and may have very little insurance available to solve it. That is why uninsured and underinsured motorist coverage on your own policy matters so much. Check your declarations page before the bad sequel arrives.

And if the other car took off? Do not spend the afternoon attempting a precision pursuit through Hernando County. Get safe, call law enforcement, document what you remember, and let someone else figure out whether there is coverage for a phantom vehicle claim.

The Non-Cinematic Ending

A real crash claim is not won by jumping a bridge, driving a car through a skyscraper, or saying “one last ride” with sufficient gravity. It is won by getting timely care, preserving evidence, understanding the coverage, and not giving the insurance company a careless sentence it can spend the next two years repeating back to you.
